This editorial suggests that amalgam is safe.  The author is the Chairman and Rapporteur of the SCENIHR Opinion on dental amalgam, and he suggests the amalgam problem is going away on its own since people are using it less and less.  He also notes that it would be legally troublesome to start following a precautionary principle.

“There is a long running debate about whether or not dental amalgams represent a serious health hazard because of the mercury they contain. A scientific opinion produced for the European Commission has recommended a solution to the conundrum and provides some lessons for other medical device related causation issues.”
